This Seller Policy applies to all users who list, offer, or sell items through BidZombie, including through auctions, Buy Now listings, or any other sales format offered on the platform.
By listing or selling an item on BidZombie, you agree to comply with this Seller Policy, the BidZombie Terms & Conditions, Prohibited & Restricted Items Policy, Shipping, Pickup & Auction Payment Policy, Returns & Refunds Policy, Privacy Policy, Fees & Commissions Policy, and all other applicable BidZombie policies and laws.1. Seller Eligibility
Sellers must:
- Maintain an active BidZombie account in good standing
- Provide accurate contact and account information
- Be legally capable of entering binding transactions
- Provide any identity, tax, banking, licensing, or business information reasonably requested by BidZombie
- Comply with all applicable federal, state, and local laws
BidZombie may require seller verification before allowing listings, payouts, or continued selling activity.
2. Ownership and Authority to Sell
Sellers may only list property they:
- Own legally, or
- Have lawful authority to sell on behalf of the owner
Sellers may not list stolen property, property obtained through fraud, property subject to undisclosed liens, or property they are not legally authorized to transfer.
BidZombie may request proof of ownership or authority to sell.
3. Accurate Listings
Sellers must provide truthful, complete, and accurate information about every item.
Listings should accurately disclose, when applicable:
- Item identity
- Brand or manufacturer
- Model
- Quantity
- Size or dimensions
- Condition
- Damage
- Defects
- Missing parts
- Repairs or alterations
- Authenticity concerns
- Whether an item is new, used, refurbished, incomplete, or untested
- Shipping or pickup requirements
- Any material fact that could reasonably affect a buyer’s decision
Sellers may not intentionally hide defects or use misleading wording, photographs, titles, or categories.
4. Photographs
Listing photographs must reasonably represent the actual item being sold unless the listing clearly states otherwise.
Sellers may not use images that materially misrepresent:
- Condition
- Quantity
- Color
- Included accessories
- Packaging
- Size
- Authenticity
- Damage
Stock photographs may be used only when appropriate and must not create a misleading impression of the actual item.
5. Auction Listings
For auction listings, sellers are responsible for accurately setting:
- Starting bid
- Bid increment
- Reserve price, if permitted
- Auction start time
- Auction end time
- Buy Now price, if applicable
- Shipping or pickup terms
- Other required auction settings
Once bidding begins, sellers may not manipulate or interfere with the auction process.
6. Shill Bidding and Bid Manipulation
Sellers may not:
- Bid on their own items
- Ask friends, family members, employees, agents, or associates to place artificial bids
- Use secondary accounts to increase prices
- Coordinate with bidders to manipulate an auction
- Retract or cancel legitimate bids for the purpose of changing an auction outcome
- Artificially inflate activity, demand, or pricing
BidZombie considers shill bidding and bid manipulation serious violations of marketplace integrity.
7. Buy Now Listings
Buy Now sellers must honor the listed price when a valid purchase is completed, unless the transaction is canceled for a legitimate reason permitted under BidZombie policies or applicable law.
Sellers may not intentionally advertise one price and demand a higher price after purchase.
8. Prohibited and Restricted Items
Sellers must comply with the BidZombie Prohibited & Restricted Items Policy.
A seller is responsible for determining whether an item may legally be:
- Listed
- Advertised
- Sold
- Shipped
- Delivered
- Transferred
- Possessed by the buyer
BidZombie may remove a listing even if the seller believes the item is lawful.
9. Seller Fees and Commissions
Sellers agree to pay all applicable BidZombie seller fees, commissions, payment-processing charges, or other disclosed charges.
The fee schedule in effect at the time of the transaction will govern unless otherwise stated.
Current standard marketplace fees are set out in the BidZombie Fees & Commissions Policy.
BidZombie may update its fees prospectively by posting revised fee information or providing notice where required.
10. Buyer’s Premium
Certain auction transactions may include a buyer’s premium paid by the winning bidder.
The buyer’s premium is separate from the seller’s commission unless BidZombie expressly states otherwise.
Sellers may not represent BidZombie fees inaccurately or attempt to collect unauthorized fees from buyers.
11. Payment Processing
Payments may be processed through third-party payment providers such as Stripe.
Sellers authorize BidZombie and its payment providers to:
- Collect buyer payments
- Deduct applicable fees
- Process refunds
- Address chargebacks
- Correct payment errors
- Hold or delay funds when reasonably necessary
- Deduct amounts owed to BidZombie where permitted
Payment processing remains subject to the terms and policies of applicable payment providers.
12. Seller Payouts
Seller payouts may be delayed or withheld when reasonably necessary to:
- Verify seller identity
- Confirm shipment or delivery
- Investigate fraud
- Resolve a buyer complaint
- Address a chargeback
- Resolve a policy violation
- Satisfy legal obligations
- Recover amounts owed to BidZombie
BidZombie does not guarantee immediate payout.
13. Shipping
When a seller is responsible for shipping, the seller must:
- Ship within the disclosed handling period
- Package the item appropriately
- Use a lawful and suitable carrier
- Provide accurate tracking when available
- Ship to the address provided through the BidZombie transaction unless BidZombie authorizes otherwise
- Follow applicable carrier and hazardous-material rules
Sellers should retain proof of shipment and delivery.
14. Local Pickup
For pickup transactions, sellers must provide reasonable pickup instructions.
Sellers should retain evidence that the buyer received the item, which may include:
- Signed pickup confirmation
- Order confirmation
- Buyer acknowledgment
- Other reasonable proof of transfer
15. Cancellations
Sellers should not cancel completed transactions without a legitimate reason.
Potential legitimate reasons may include:
- Buyer requests cancellation
- Payment failure
- Item was destroyed, lost, or materially damaged before transfer
- Listing contained a genuine material error
- Transaction would violate law or BidZombie policy
- Suspected fraud
Repeated seller cancellations may result in selling restrictions.
16. Returns and Refunds
Sellers must comply with the BidZombie Returns & Refunds Policy.
Sellers may not create listing terms that conflict with BidZombie’s platform-wide return or refund rules.
Where a refund is required, BidZombie may process the refund through the original payment method.
17. Chargebacks and Payment Disputes
If a buyer disputes a payment, the seller must cooperate with BidZombie and provide requested evidence promptly.
Evidence may include:
- Tracking information
- Delivery confirmation
- Pickup confirmation
- Listing photographs
- Item condition photographs
- Communications with the buyer
- Order details
- Proof of refund
If a payment provider determines that funds must be returned to the buyer, BidZombie may recover the disputed amount and applicable costs from seller funds, future payouts, or other legally permitted means.
18. Off-Platform Transactions
Sellers may not use BidZombie listings or buyer contact to circumvent BidZombie fees.
A seller may not direct a buyer to complete a transaction outside BidZombie when the buyer was introduced to the item through BidZombie.
This includes attempts to:
- Collect payment directly
- Avoid seller fees
- Avoid buyer premiums
- Cancel a BidZombie transaction and complete the same sale privately
19. Communications with Buyers
Sellers must communicate professionally and may not:
- Harass buyers
- Threaten buyers
- Discriminate unlawfully
- Send unrelated marketing without permission
- Misuse buyer contact information
- Pressure buyers to bypass BidZombie
Buyer information may only be used as reasonably necessary to complete or support the transaction.
20. Feedback and Reputation Manipulation
Sellers may not manipulate ratings, reviews, feedback, or marketplace reputation.
Prohibited conduct includes:
- Creating fake transactions to improve reputation
- Using multiple accounts to generate feedback
- Offering compensation in exchange for false positive feedback
- Providing false tracking or transaction information
21. Taxes
Sellers are responsible for their own tax obligations arising from selling activity.
BidZombie may:
- Collect and remit taxes where required
- Request taxpayer information
- Issue tax reporting documents
- Report seller activity to tax authorities where legally required
Sellers should consult a qualified tax professional regarding their individual obligations.
22. Intellectual Property
Sellers must not list items that violate another party’s:
- Copyright
- Trademark
- Patent
- Publicity rights
- Other intellectual property rights
BidZombie may remove listings in response to valid intellectual-property complaints.
23. Cooperation with Investigations
Sellers must reasonably cooperate with BidZombie investigations involving:
- Fraud
- Chargebacks
- Stolen property
- Counterfeit merchandise
- Buyer complaints
- Legal requests
- Safety issues
- Marketplace abuse
Failure to cooperate may result in account restrictions or withheld payouts.
24. Seller Performance
BidZombie may evaluate seller performance based on factors such as:
- Accurate listings
- Shipment speed
- Delivery
- Cancellation rate
- Buyer complaints
- Disputes
- Chargebacks
- Policy violations
- Responsiveness
- Transaction completion
BidZombie may limit or suspend selling privileges where seller performance creates unreasonable marketplace risk.
25. Enforcement
BidZombie may take action when a seller violates this Policy, including:
- Removing listings
- Canceling transactions
- Canceling bids
- Issuing warnings
- Limiting listings
- Holding payouts
- Recovering amounts owed
- Restricting selling privileges
- Temporarily suspending accounts
- Permanently terminating accounts
- Reporting unlawful conduct when appropriate
The specific action taken may depend on the severity, frequency, and circumstances of the violation.
26. Seller Responsibility
Sellers remain responsible for their items, representations, legal compliance, shipment or pickup obligations, and transactions.
BidZombie’s review or failure to remove a listing does not constitute approval, authentication, legal advice, or a guarantee that the item complies with law or policy.
27. Changes to This Policy
BidZombie may update this Seller Policy from time to time.
The current version posted on BidZombie will apply from its effective date forward.
