This Bidder & Buyer Policy applies to all users who place bids, participate in auctions, make Buy Now purchases, or otherwise purchase items through BidZombie.
By creating an account, placing a bid, winning an auction, making a Buy Now purchase, or completing a transaction through BidZombie, you agree to comply with this Policy, the BidZombie Terms & Conditions, Shipping, Pickup & Auction Payment Policy, Returns & Refunds Policy, Prohibited & Restricted Items Policy, Privacy Policy, Fees & Commissions Policy, and all other applicable BidZombie policies and laws.
1. Buyer Eligibility
Buyers and bidders must:
- Maintain an active BidZombie account in good standing
- Provide accurate contact, billing, shipping, and account information
- Be legally capable of entering binding transactions
- Use only payment methods they are authorized to use
- Comply with applicable federal, state, and local laws
BidZombie may restrict or suspend bidding or purchasing privileges when necessary to protect the marketplace.
2. Bids Are Binding
A bid placed through BidZombie is a binding commitment to purchase the item if the bidder becomes the winning bidder, subject to applicable law and BidZombie policies.
Bidders should carefully review the listing before placing a bid.
Once submitted, bids generally may not be withdrawn or canceled merely because the bidder:
- Changed their mind
- Bid more than intended
- Failed to read the listing
- Failed to review shipping or pickup terms
- Failed to consider applicable fees
- Found the item elsewhere for less
- No longer wants the item
BidZombie may permit cancellation or correction in limited circumstances at its discretion.
3. Bidder Responsibility
Before bidding, buyers should review:
- Item description
- Photographs
- Condition
- Quantity
- Current bid
- Minimum next bid
- Bid increment
- Auction end time
- Shipping terms
- Pickup requirements
- Buyer’s premium
- Taxes
- Other disclosed fees
- Applicable policies
Bidders are responsible for understanding the transaction before placing a bid.
4. Maximum Bids and Proxy Bidding
If BidZombie offers automatic or proxy bidding, a bidder may enter a maximum amount they are willing to pay.
The system may automatically increase that bidder’s visible bid only as necessary to remain the high bidder, subject to applicable bid increments and competing bids.
A bidder’s maximum bid may not necessarily be displayed publicly.
5. Bid Increments
Auction bids must comply with the minimum bid increment displayed for the auction.
Bid increments may vary by item, auction, price level, or other marketplace settings.
BidZombie may reject bids that do not meet the minimum required amount.
6. Auction Closing and Soft Close
BidZombie may use a soft-close or anti-sniping system to reduce last-second bidding.
Where a soft close applies, qualifying bids placed within the designated closing period may extend the auction.
BidZombie may use different timing rules depending on the auction configuration.
The auction page and applicable auction terms control the actual closing procedure.
Bidders should not assume that the originally displayed closing time will remain unchanged if bidding activity triggers an extension.
7. Winning Bidder
The highest valid bid at the time the auction closes is generally the winning bid, subject to:
- Reserve-price requirements
- Payment requirements
- Fraud review
- Technical issues
- Bid validity
- BidZombie policies
- Applicable law
BidZombie may cancel or invalidate bids or transactions when reasonably necessary.
8. Reserve Prices
Certain auctions may use a reserve price.
If the reserve price is not met, the seller may not be required to sell the item.
Where applicable, the auction page may indicate whether the reserve has been met.
9. Buy Now Purchases
A Buy Now purchase is generally binding once the buyer completes the purchase through BidZombie.
Buyers are responsible for reviewing the listing, price, condition, shipping or pickup terms, applicable taxes, and fees before completing the order.
10. Buyer’s Premium and Fees
Auction purchases may include a buyer’s premium or other disclosed buyer fees.
The applicable fee schedule will be stated in BidZombie’s Fees & Commissions Policy and/or the applicable listing or checkout page.
Buyers are responsible for all disclosed charges associated with the transaction.
11. Taxes
Buyers are responsible for applicable taxes unless BidZombie or another party is legally required to collect and remit those taxes.
Where required, sales tax may be added at checkout or otherwise collected as part of the transaction.
12. Payment
Winning bidders and Buy Now purchasers must pay using an accepted payment method within the required payment period.
Payment obligations may include:
- Winning bid or purchase price
- Buyer’s premium
- Sales tax
- Shipping
- Handling
- Other disclosed charges
Failure to pay may result in order cancellation, account restriction, suspension, or other action under BidZombie policies.
13. Payment Authorization
By submitting a payment method, the buyer represents that:
- The buyer is authorized to use the payment method
- The payment information is accurate
- BidZombie and its payment processors may attempt to process the transaction
- Applicable charges may be submitted to the payment provider
Payment processing may be handled through third-party services such as Stripe.
14. Failed Payments
If a payment is declined, rejected, reversed, or otherwise unsuccessful, the buyer remains responsible for completing payment unless BidZombie cancels the transaction.
BidZombie may:
- Request another payment method
- Retry payment where permitted
- Cancel the transaction
- Restrict the account
- Prevent additional bidding or purchasing
15. Chargebacks and Payment Disputes
Buyers should contact BidZombie before initiating a payment dispute when reasonably possible so that the issue can be reviewed.
Buyers may not knowingly file fraudulent, misleading, or abusive chargebacks.
BidZombie may submit transaction records, listing information, shipping evidence, pickup confirmation, communications, or other relevant documentation to a payment processor or financial institution in response to a dispute.
Abusive or repeated improper chargebacks may result in account restriction or termination.
16. Shipping
Buyers are responsible for reviewing shipping terms before bidding or purchasing.
Where shipping applies, buyers may be responsible for:
- Shipping charges
- Handling charges
- Insurance where applicable
- Accurate shipping information
- Accepting delivery
- Complying with carrier requirements
Buyers should ensure that their shipping address is complete and correct before completing payment.
17. Local Pickup
Where local pickup is offered, buyers are responsible for:
- Reviewing pickup location and instructions
- Appearing within the stated pickup period
- Bringing any required identification or documentation
- Arranging suitable transportation
- Bringing necessary help or equipment for large or heavy items
- Inspecting the item where appropriate before removal
Failure to pick up an item within the required period may result in storage fees, cancellation, forfeiture, or other consequences stated in the applicable policy or listing.
18. Inspection and Item Condition
Many auction items may be used, pre-owned, vintage, untested, incomplete, or sold in as-is condition.
Buyers should carefully review all listing information and photographs.
Unless otherwise stated, photographs are part of the item description.
Normal wear, age, cosmetic defects, or other disclosed conditions are not grounds for cancellation merely because the buyer later decides the condition is undesirable.
19. Returns and Refunds
Buyers must comply with the BidZombie Returns & Refunds Policy.
Unless otherwise required by law or expressly permitted under that policy, auction and Buy Now sales may be final.
Buyers should not assume that ordinary retail return rights apply to auction purchases.
20. Prohibited Buyer Conduct
Buyers may not:
- Place bids they do not intend to honor
- Use false account information
- Use stolen or unauthorized payment methods
- Coordinate bids to manipulate auction results
- Harass sellers or other users
- Threaten or intimidate users
- Attempt to bypass BidZombie fees
- Complete off-platform transactions to avoid marketplace charges
- Abuse refund or chargeback processes
- Manipulate feedback or account reputation
- Use multiple accounts to gain an unfair advantage
- Interfere with the operation of the marketplace
21. Bid Manipulation and Collusion
Buyers may not coordinate with sellers or other bidders to:
- Artificially raise or suppress prices
- Discourage legitimate bidding
- Create fake competition
- Split or allocate items improperly
- Circumvent auction rules
- Distort marketplace activity
BidZombie may cancel bids or transactions where manipulation is suspected.
22. Off-Platform Transactions
Buyers may not use BidZombie to identify an item or seller and then intentionally complete the same transaction outside BidZombie for the purpose of avoiding fees or platform rules.
Such conduct may result in account restriction or termination.
23. Account Security
Buyers are responsible for maintaining the confidentiality of their login credentials.
Activity performed through a buyer’s account may be treated as authorized unless BidZombie is promptly notified of suspected unauthorized access.
Buyers should report suspected account compromise immediately.
24. Communications
Buyers must communicate professionally and may not misuse seller contact information.
Buyer communications may not be used for:
- Harassment
- Threats
- Unrelated marketing
- Spam
- Fraud
- Attempts to bypass BidZombie
25. Technical Issues
BidZombie does not guarantee uninterrupted access to auctions or marketplace services.
Technical issues may include:
- Internet outages
- Device problems
- Browser problems
- Hosting issues
- Payment processor interruptions
- Software errors
- Delayed page refreshes
- Other system failures
BidZombie may take reasonable action when a technical issue materially affects an auction or transaction, including extending, pausing, canceling, or reviewing the affected transaction.
26. Listing Errors
BidZombie or a seller may correct or cancel a transaction when a listing contains a material error involving information such as:
- Item identity
- Price
- Quantity
- Availability
- Auction settings
- Condition
- Shipping terms
Such corrections should be limited to genuine errors and not used to avoid a legitimate sale merely because the final price was lower than expected.
27. Fraud Prevention
BidZombie may review bidding, payment, account, device, transaction, and other information to prevent or investigate fraud.
BidZombie may require additional verification before allowing a buyer to bid, purchase, or complete payment.
28. Account Restrictions
BidZombie may restrict, suspend, or terminate buyer privileges for reasons including:
- Failure to pay
- Fraud
- Chargeback abuse
- Bid manipulation
- Multiple unpaid wins
- Policy violations
- Harassment
- Identity concerns
- Marketplace abuse
- Security risks
Restrictions may apply to bidding, purchasing, account access, or other platform functions.
29. Cancellation by BidZombie
BidZombie may cancel bids, auctions, orders, or transactions when reasonably necessary to:
- Correct material errors
- Prevent fraud
- Address technical failures
- Comply with law
- Enforce policies
- Protect users
- Resolve payment problems
- Address prohibited items
- Maintain marketplace integrity
30. No Guarantee of Item Value
BidZombie does not guarantee:
- Market value
- Resale value
- Future value
- Collectibility
- Authenticity unless expressly stated
- Fitness for a particular purpose
- Suitability for a buyer’s intended use
Buyers are responsible for making their own purchasing decisions.
31. Buyer Responsibility
Each buyer remains responsible for:
- Reviewing listings
- Understanding auction rules
- Understanding fees
- Paying for valid purchases
- Providing accurate information
- Complying with shipping or pickup requirements
- Complying with applicable law
- Using the marketplace responsibly
32. Changes to This Policy
BidZombie may update this Bidder & Buyer Policy periodically.
The current version posted on BidZombie will apply from its effective date forward.
