BidZombie DMCA & Intellectual Property Policy

BidZombie, operated by TNT Liquidations LLC (“BidZombie,” “we,” “us,” or “our”), respects the intellectual property rights of others and expects all users, sellers, buyers, and other participants on the BidZombie platform to do the same.
This policy explains how copyright and other intellectual property complaints are handled on BidZombie.
1. User Responsibility for Content and Listings
Users and sellers are responsible for ensuring that all photographs, descriptions, logos, graphics, text, product images, artwork, trademarks, copyrighted material, and other content they upload, post, display, sell, or otherwise make available through BidZombie do not violate the intellectual property rights of any third party.
By submitting content or creating a listing on BidZombie, the user represents that they own the content or have the necessary rights, licenses, permissions, or legal authority to use it.
BidZombie may remove or disable access to content or listings that we reasonably believe may violate copyright, trademark, or other intellectual property rights.
2. Copyright Infringement Notices — DMCA Takedown Requests
If you believe copyrighted material is being used on BidZombie without authorization, you may submit a written notification pursuant to the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.
A valid notice should include substantially the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner’s behalf.
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
- Identification of the material claimed to be infringing and information reasonably sufficient for BidZombie to locate the material, such as the listing URL, item number, seller name, or other identifying information.
- Your name and contact information, including mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.

4. Our Response to Copyright Notices
Upon receiving a substantially compliant DMCA notification, BidZombie may act expeditiously to remove or disable access to the material identified in the notice.
BidZombie may also notify the user who posted the affected material and provide information concerning the complaint.
Removal of material does not constitute a determination by BidZombie that infringement actually occurred. BidZombie is not a court and does not adjudicate ownership disputes between users and rights holders.
5. DMCA Counter-Notifications
If material you posted was removed or disabled because of a DMCA notice and you believe the removal resulted from mistake or misidentification, you may submit a counter-notification to the BidZombie DMCA Agent.
A valid counter-notification should include substantially the following:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification.
- Your name, address, and telephone number, together with the legally required statement consenting to the jurisdiction of the appropriate United States federal district court and agreeing to accept service of process from the person who submitted the original DMCA notice or that person’s agent.
A counter-notification should be sent to the DMCA Agent identified above.
6. Restoration Following a Counter-Notification
When BidZombie receives a valid counter-notification, we may provide a copy to the person who submitted the original infringement notice.
Subject to applicable law, the removed material may be restored not less than 10 and not more than 14 business days after receipt of a valid counter-notification unless BidZombie receives legally sufficient notice that the complaining party has initiated an action that prevents restoration of the material.
7. Repeat Infringer Policy
BidZombie maintains a policy providing for the termination, in appropriate circumstances, of users or account holders who are repeat infringers.
Depending on the circumstances, BidZombie may issue warnings, remove listings or content, restrict account privileges, suspend accounts, permanently terminate accounts, or take other appropriate action.
BidZombie reserves the right to act immediately in cases involving serious, deliberate, fraudulent, or repeated intellectual property violations.
8. Misrepresentations and Abuse of the DMCA Process
DMCA notices and counter-notifications are legal communications.
Any person who knowingly materially misrepresents that material is infringing, or knowingly materially misrepresents that material was removed or disabled because of mistake or misidentification, may be subject to liability under applicable law, including 17 U.S.C. § 512(f).
Users should not submit false, fraudulent, abusive, retaliatory, or misleading intellectual property complaints.
9. Trademark and Other Intellectual Property Complaints
The DMCA process described above applies specifically to copyright claims.
If you believe a BidZombie listing or user is infringing a trademark, service mark, trade name, patent, right of publicity, or other intellectual property right, contact:

Please include enough information for BidZombie to evaluate the complaint, including:
• Your name and contact information
• Identification of the intellectual property right involved
• Registration information, if applicable
• The BidZombie listing, user, or content at issue
• The reason you believe the material infringes your rights
• Documentation showing your ownership or authority to act for the rights holder
• A statement that the information provided is accurate
BidZombie may request additional information before acting on a non-copyright intellectual property complaint.
10. Seller Listings and Third-Party Content
BidZombie operates an online marketplace through which third-party sellers may create listings and provide content.
The presence of a listing on BidZombie does not mean that BidZombie owns, endorses, licenses, authenticates, or independently verifies all intellectual property associated with that listing.
Sellers remain responsible for the legality of their listings and for obtaining any rights necessary to use photographs, descriptions, brand names, logos, artwork, or other protected material.
11. Removal and Account Enforcement
BidZombie reserves the right, consistent with applicable law and our other policies, to remove or restrict listings or content, suspend transactions, restrict account functionality, request additional documentation, suspend accounts, or terminate users where intellectual property concerns arise.
Nothing in this policy limits BidZombie’s ability to remove content or take action under its Terms and Conditions, Seller Policy, Prohibited and Restricted Items Policy, or other applicable policies.
12. Changes to This Policy
BidZombie may update this DMCA & Intellectual Property Policy from time to time to reflect changes in law, regulations, platform operations, or our procedures.
